FALLS CHURCH, Va. (WUSA) -- Mark Grapin promised his two sons he would build a tree house when he returned from Iraq. After it was built, a battle with the county began.

On Wednesday, he appeared once again in front of the Fairfax County Zoning Board and appealed. He won, but there are some stipulations.

It has to come down in five years.

"Obviously we have to keep the tree house in good order," he said, "the shrubbery and plants have to be maintained."

Grapin said a neighbor volunteered to help plant evergreens around the tree house.

"He brought a crew out and they planted these. He was able to tap the generosity of Merrifield Gardens. They were very generous," Grapin said.

The trees were donated and planted for free. One of the trees still had a $249 price tag

FREDERICK, Md. (WUSA) -- Tests are being done after an odor was detected during drilling at Fort Detrick. It's concerning because the odor is coming from an area that's been contaminated with toxins.

Contaminants were buried at the site when Fort Detrick's Biological Weapons program

Robert Sperling with Fort Detrick said employees noticed the odor last Wednesday while they were installing a well. But that information wasn't released until Saturday morning.

"Once they smelled the odors, they stopped what they were doing, and they put on protective gear, they put on a respirator," he said in a phone interview with 9 NEWS NOW's Lindsey Mastis

Sperling said vapor didn't travel off base and therefore, is not a threat to the community.

"We had did some tests downwind and really nothing was detected past about 10 feet from the actual drill," Sperling said.
